We regularly reach out to customers to request additional rights to reproduce our favorite images in our social feed, catalog, email, website + more. Whenever possible, we also include your handle or byline. Below are our terms and conditions for using and sharing any User Generated Content on our channels. Please read it thoroughly before accepting our request.
Acceptance of Terms
By submitting your User-Generated Content (UGC) to LuxenHome and its affiliated platforms, you agree to these UGC Usage Terms and Conditions. Please read these terms carefully before sharing your content with us.
Definitions
- UGC: User-Generated Content refers to any content, including but not limited to text, images, videos, or other media, created and shared by users on LuxenHome's platforms or tagged with LuxenHome's official hashtag.
- Brand: LuxenHome or any of its affiliated entities.
- Creator: The individual or entity who created and owns the UGC.
Grant of License
By submitting your UGC to LuxenHome, you grant LuxenHome a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, distribute, modify, adapt, publicly display, and publicly perform your UGC for the following purposes:
- Promotion: LuxenHome may use your UGC for promotional and marketing purposes, including but not limited to social media, advertisements, website content, and other promotional materials.
- Branding: LuxenHome may use your UGC to promote and enhance its brand.
- Engagement: LuxenHome may engage with your UGC by liking, sharing, or commenting on it, and may respond to comments and engage with users on the post.
- Product Development: LuxenHome may use insights gained from UGC to improve products, services, and customer experiences.
Rights and Ownership
You retain all rights and ownership of your UGC. LuxenHome does not claim ownership of your content. By submitting your UGC, you represent and warrant that you have the necessary rights to grant the license described above.
Attribution
LuxenHome will make reasonable efforts to provide attribution to the creator whenever the UGC is used. However, LuxenHome is not obligated to provide attribution, and the lack of attribution does not constitute a breach of these terms.
Content Guidelines
- UGC must comply with LuxenHome's content guidelines, which may include quality standards, themes, or any legal restrictions. UGC that violates these guidelines may not be used or may be removed.
- UGC must not contain any illegal, offensive, discriminatory, or harmful content. LuxenHome reserves the right to remove or refuse to use any UGC that is deemed inappropriate.
Duration of Use
LuxenHome may use your UGC indefinitely unless otherwise specified. If you wish to have your UGC removed, please contact marketing@winsomehouse.com with a request for removal.
Dispute Resolution
Any disputes or concerns related to UGC usage should be directed to marketing@winsomehouse.com. LuxenHome will make reasonable efforts to address and resolve disputes in a timely manner.
Termination Rights
LuxenHome reserves the right to remove or cease using any UGC at its discretion, especially if it violates any of the agreed-upon terms or if there are legal concerns.
Governing Law
These UGC Usage Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California.
Changes to Terms
LuxenHome reserves the right to update or modify these UGC Usage Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised terms on LuxenHome's platforms.
